Bank of America Corp (NYSE: BAC) has been sued by a property preservation company on charges of deceit, fraud and breach of contract as well as unjust enrichment in a civil suit in California.

Diversified Field Services of Tustin, California, which maintains foreclosed properties for banks, says in its lawsuit that Bank of America Corp (NYSE: BAC) signed a Diversified Field Services to maintain repossessed homes in 14 states last year.

The company said that it spent more than $2 million preparing to do the work that Bank of America Corp (NYSE: BAC) contracted it to do, but that the work never came.

“Homeowners are not the only victims of this [mortgage] crisis; it extends to firms like DFS and onward to the mom-and-pop businesses who actually mow the lawns and clean the countless homes that now sit empty,” said DFS attorney Eric Goodman.

Citigroup Inc. spent $1.31 million during the first quarter to lobby the government on financial regulatory reform and other issues tied to lending, according to a disclosure filing.

The New York-based bank spent 5 percent more than the $1.25 million it spent during the same quarter last year and in the final quarter of 2009.

Halliburton, Superior Well Rise as Macquarie Ups to Buy

Shares of Halliburton (HAL) are up 9 cents at $26.43, after Macquarie Securities analyst Waqar Syed raised his rating on the stock to “Outperform” from “Neutral,” along with shares of Superior Well Services (SWSI), another energy services firm.

SWSI is up 44 cents, or 2.7%, at $16.79, clearly enjoying a bigger bounce from this upgrade.

Syed raised his price target on HAL to $40 from $36, and to $25 from $20 for SWSI

The key point is demand is outstripping supply for the kinds of “pressure pumping” that HAL and Superior offer to oil and gas exploration firms. “effective pressure pumping utilization is now 100%, and in some regions, equipment is working 24/7.”

“Utilization conditions are fast approaching the very frothy 2006 tightness levels, although pricing is still well below,” writes Syed.

Clients are now being wait-listed for work by Halliburton and Superior, writes Syed, by as much as four months.

June 28 (Bloomberg) -- Stocks in Switzerland gained for the first time in five days after Group of 20 leaders pledged to work to spur economic growth as nations tackle budget deficits. Transocean Ltd. and ABB Ltd. led the advance.

Transocean, the company that leased the Deepwater Horizon drilling rig in the Gulf of Mexico to BP Plc, rose 1.7 percent as the U.K. oil company reiterated its August timeline for plugging the well. ABB climbed 1.2 percent after Finanz und Wirtschaft reported that the world’s biggest builder of power- transmission networks is weighing further takeover targets.

The Swiss Market Index of the biggest and most actively traded companies rose 0.5 percent to 6,308.47 at 12:45 p.m. in Zurich. The broader Swiss Performance Index also gained 0.5 percent.

The SMI has declined 9.5 percent from this year’s high on April 15 on concern a sovereign-debt crisis in Europe will slow growth and speculation the Chinese authorities are moving to cool the world’s largest emerging economy. Meeting in Toronto yesterday, the G-20 meeting of the world’s largest economies reached agreement that they must still focus on spurring growth even as countries start tightening spending.

Boeing Machinists Accept Contract Offer, Won’t Strike

Boeing Co. machinists at a St. Louis fighter-jet plant won’t strike tomorrow after voting today to accept a proposed contract that will put new workers in a 401(k)-style pension.

The four-and-a-half year contract was accepted by a vote of 1,237 to 838, two weeks after union members rejected the contract.

“There will be no strike,” said Tom Pinski, a spokesman for the International Association of Machinists and Aerospace Workers district 837. The union represents about 2,500 machinists. A strike would have halted production of F-15 and F- 18 jets.

The contract leaves in a place a Boeing proposal to put workers hired after January 2012 into a 401(k)-style plan rather than a defined benefit plan. The agreement calls for a 3 percent wage increase in the second through fifth years, Pinski said. The company removed language that would have dropped dependents’ medical coverage if an employee was on medical leave for more than six months, he said.

“I’m not sure they were voting in favor of the 401(k) plan, they were voting that Boeing would be adamant enough and harsh enough that even if they went on strike they still would not be able to retain a defined pension plan,” Pinski said.

British Petroleum (NYSE: BP) shares plunged 6% on Friday, closing to a 14-year low amid growing concerns that the total liability associated with the oil spill in the Gulf will be larger than expected.

As BP shares continue to retreat for the ninth straight week, the company’s market value has dropped by approximately $100 billion since an explosion at one of its deepwater rigs sank to the bottom of the Gulf in late April.

Rising costs, inevitable legal liabilities, and BP’s inability to stop the leak of an estimated 2.0 million gallons per day, have increasingly spooked shareholders to sell their shares.

BP is under increasing pressure to assure the costs associated with capping the well and future costs to clean the Gulf, which the company says has reached $2.35 billion already.

Given the high costs in the debt market, analyst Alastair Syme of Nomura Securities Co. said he believes an equity investor may be needed in the short term to fund the crisis, further diluting the shares.

The 38-fold surge in Apple shares that drove the iPhone seller past Microsoft market value means the company may be “too big to succeed,” according to research from Rob Arnott.

Research Affiliates LLC found that since 1953, shares of the biggest Standard & Poor’s 500 Index company in an industry trailed the average stock by 2.4% a year in the next decade. The chart shows the market value of Apple, whose stock rallied to $270.17 on Wednesday from $7.17 at the end of 2002, passed Redmond, Washington-based Microsoft’s in May following the introduction of the iPad tablet computer.

Apple, based in Cupertino, California, has increased net income seven straight years, following the release of the iPod music player in 2001 and the iPhone in 2007.

The iPad came out in April, and Apple is forecast to report record profit of $12.4 billion in the fiscal year ending in September, according to the average of 28 analyst estimates in a survey.

Are traders speculating bullishly, or just hedging their bets?

QUALCOMM, Inc. (QCOM) has become a favorite target of call buyers lately. During the past five days, the International Securities Exchange (ISE) reports that traders have bought to open 14,684 calls on the equity, compared to 920 puts. The security's five-day call/put volume ratio of 15.96 reveals that nearly 16 times more bullish bets than bearish were purchased during this time frame.

Taking a slightly longer-term look, QCOM's 10-day ISE call/put volume ratio smoothes out to a tamer 2.23, with calls bought to open more than doubling puts during the past two weeks. This ratio ranks in the 73rd annual percentile, suggesting that traders have snapped up calls over puts at a faster pace just 27% of the time during the past year.

However, the equity's Schaeffer's put/call open interest ratio (SOIR) of 0.87 indicates that skepticism still lingers among near-term traders. This ratio arrives in the 55th annual percentile, just barely on the bearish side of neutral.

Shares of Dendreon are off over 2% today and down 12% in the past week despite the S&P being down about 0.4%. But even more importantly, DNDN, currently at 34 and change, is 23 points off its high of 57.67, which it reached after the FDA approved the prostate drug Provenge. What is going on here?

Clearly, some people/funds were in it for the short haul. They were making the bet that Provenge was going to get approved and the stock would pop. The drug got approved, the stock popped, and as per their plan, they bailed on the stock and are probably still bailing. If you held it at 10, 15, 35, and were happy to see it pop to 57, there’s no reason for you to hold out for $70 where it can probably go once its drug starts selling and producing profits.

Part of the concern is that people are afraid Dendreon might miss analyst estimates on the quarter. They are just beginning selling Provenge and estimates are for about $7 million. Any miss here is meaningless. This is a drug that eventually will bring in billions of dollars a year.

Shares in BP have fallen further amid speculation that the company may have to seek extra funds to pay for its oil spill costs.

Shares were down by 7% at one stage, hitting a 14-year low.

In a note to investors trading house Nomura said pressure was growing on the company to "assure sufficient funding" to stop the spill.

Earlier BP said that its costs linked to the Gulf of Mexico oil disaster had risen to $2.35bn (£1.57bn).

The total costs, including compensation claims, are expected to be much higher.

"We consider that equity linked financing - perhaps backed by sovereign wealth - could prove the attractive short-term solution," said Nomura,

It added that BP's perceived need for more money was damaging the company in the eyes of investors.

Transocean Ltd. must comply with a subpoena from a joint panel of the U.S. Coast Guard and Minerals Management Service that is investigating the explosion that sank the Deepwater Horizon drilling rig off the Louisiana coast, killing 11 and causing the worst oil spill in U.S. history.

U.S. District Judge Keith Ellison in Houston today rejected the request by Transocean, the rig’s owner, to block the panel’s subpoena, which was approved by a different federal judge in New Orleans. Ellison is overseeing Transocean’s attempt to limit its liability related to the sunken rig.

Transocean’s lawyers said they feared turning over the rig’s work logs, records and physical debris would put it in violation of other court orders and a request by the U.S. Justice Department to preserve and maintain all evidence related to the disaster.

Oil company BP says it has spent $2 billion responding to the massive oil leak in the Gulf of Mexico.

In a statement Monday, the British energy company said its costs to date include ongoing containment efforts, relief well drilling, federal costs and claims paid to affected individuals and businesses.

The company last week agreed to establish a $20 billion fund to compensate victims of the disaster. It said Monday it has so far paid out $105 million in response to 32,000 claims resulting from the leak, caused by an explosion at a deepwater oil rig two months ago.

Although Sirius XM Radio (NASDAQ:SIRI) has triggered a bearish signal by breaking through its rising triangle pattern, the stock action seems to be trading into a channel as outlined by one of two scenarios in a previous article . Let’s take a look at the daily and weekly charts again.

The Daily chart shows where Siri broke down through the rising triangle back in May but so far has not broken through major support levels. Instead it is trading within a .10 cent channel between .95 and 1.05 and has broken back up through a short term down trend. The break upward is not very significant because of the low volume, hence the channel. Considering the state of the market I think a channel is good news.

June 15 (Bloomberg) -- BP Plc Chief Executive Officer Tony Hayward is being pressed about cost-cutting that House Democrats said added to the danger of an explosion at the company’s Gulf of Mexico oil well.

“Time after time, it appears that BP made decisions that increased the risk of a blowout to save the company time or expense,” U.S. Representatives Henry Waxman of California and Bart Stupak of Michigan said in a letter yesterday to Hayward. “If this is what happened, BP’s carelessness and complacency have inflicted a heavy toll on the Gulf, its inhabitants, and the workers on the rig.”

"We saw a 30% sequential jump in purpose-built switch sales in the first quarter of 2010, with Cisco a driving force with their Nexus switch line," explained Infonetics analyst Matthias Machinowski in a statement. "Healthy annual growth is expected to continue in this segment."

SAN JOSE, Calif. (TheStreet) -- Cisco(CSCO) may be pulling out all the Hollywood-star stops to sell its latest technology, but investors should also be keeping an eye on the infinitely less sexy world of network gear.

Cisco saw its Ethernet switch revenue leap 23.5% between the fourth quarter of last year and the first quarter of 2010, according to the latest numbers from Infonetics Research. Cisco's Nexus product was the major driver of this growth, reflecting a broader rebound in enterprise data center spending.

NEW YORK (MarketWatch) -- Shares of Best Buy Co. fell sharply Tuesday after the largest U.S. electronics retailer reported worse-than-expected fiscal first-quarter profit and sales, after it increased expenses and lower sales of flat panel televisions, video games and services capped gains in the U.S.

Best Buy shares fell 6.7% to $38.30 in pre-market trading.

Best Buy's net income rose slightly to $155 million from $153 million a year earlier.

Per-share profit was unchanged at 36 cents. Sales in the quarter ended May 29 climbed 7% to $10.8 billion from $10.1 billion.

Comparable sales, or those at stores, call centers and Web sites open at least 14 months, increased 2.8%.

General Electric (GE) was a stock to sell. In fact, for most of this century GE stock shares were dead money. After General Electric peaked at around $60 a share in late 2000, the stock moved steadily downward before finding a comfortable range between $25 and $35 for the most of the decade.

This is our worst nightmare. The oil industry has killed the Gulf of Mexico.

My worst fears have been realized. If this link is true and the oil is coming through the sea floor, they have either blown out the formation or blown out the cement (which we know they did anyway to get the blowout to occur). I am beginning to realize why they have not wanted toclose the valves on the cap. The more theyclose it, the more oil is going to come up through the sea floor, next to the well casing. I listed 12 points in my attached article. The really big concern here is that their directional wells are now pointless. They are GUARANTEED to fail because you can not pump mud or cement into a blown out well. It just does not set with oil and gas roaring past.

Today, BP said that the total cost in response to the oil spill has reached about $1.6 billion.

BP updated its shareholders this morning at the start of a crucial week for the company. It said the total bill has jumped by $350m in the last week, including payments of $25m each to the states of Florida, Alabama and Mississippi to help them fight the environmental damage of the disaster.

BP will start taking oil and gas to a ship on the surface through a separate pipe in the next few days, and a “more permanent and flexible” system with floating risers is set to begin operations around the end of the month, the company said in a statement in London today.

BP.L is currently trading at 379.9 pence, down 12 pence or 3.06%, on a volume of 25.84 million shares. BP closed Friday's regular trading at $33.97 on the NYSE.

Auto sales increase will lead to Sirius XM shares rose

According to Efraim Levy, an analyst at Standard & Poor's, new U.S. vehicle sales should rise 12.7% to 11.7 million units in 2010, and another 15% to 13.5 million in 2011. "We expect industry-wide revenues and profits to improve significantly in both years," he wrote in a recent research note.

The company should continue to grow subscribers as U.S. car sales pick up with its service available in about 60% of new cars sold.

Mobile Internet-enabled devices could help SIRI’s growth.

Sirius shares were up 1.8% to 98 cents in recent trades, while E*Trade's stock, which underwent a reverse 1-for-10 split on June 2, was up 4% to $13.51 on Thursday. BP plc (BP) says it's puzzled by a drop in its share price, which fell 16% Wednesday in trading on the NYSE. The stock dropped as low as $33, down from a 52-week high of $62.38. BP's market cap is now only $91 billion.

As BP finds itself caught between an angry U.S. administration and unhappy shareholders, Prime Minister David Cameron's office said the British leader would discuss the issue with President Barack Obama on a scheduled telephone call over the weekend.

In a lawsuit filed May 21 in the Houston Division of the Southern District of Texas, the insurers say BP submitted a notice of claim to the Transocean Excess Insurers via e-mail. But the plaintiffs claim BP is not eligible for more coverage since the pollution is of BP's making.

Shares in Tellabs Inc (TLAB.O) were down 6.3 percent on Tuesday after Morgan Stanley downgraded the telecommunications equipment maker's shares, citing an expectation that AT&T Inc (T.N) would switch to Cisco Systems (CSCO.O).

Tellabs shares fell 44 cents to $6.37 on Nasdaq after Morgan Stanley analyst Ehud Gelblum said AT&T is planning a "relatively quick transition away from" Tellabs 8860 router to a product from Cisco about a year from now.

AT&T, which brought in 21 percent of Tellabs revenue in 2009, declined comment as did Cisco.

Tellabs spokesman George Stenitzer said investors appeared to be overreacting to a rumor in the market and referred questions about AT&T to the operator itself as his company was unable to comment on their current agreement.

BP faces a tough balancing act, caught between worried investors and an increasingly angry U.S. government and public. It's a key stock for millions of investors and pension funds.

About 40 percent of BP shares are held in the U.S. The stock also accounts for about 6 percent of all the UK equity money held by defined benefit pension schemes.

BP has already spent about $1 billion on cleanup costs. CEO Tony “I’d like my life back” Hayward says the eventual cost could be about $3 billion. Which is being roundly laughed at as the lowball of the year. “I’m pretty damn confident that the Street is not buying that,” says New Orleans–based oil analyst Blake Fernandez. A more accurate estimate seems to be in the realm of $10 billion and up, to maybe $30 billion.

Investors are increasingly worried about Halliburton's financial exposure to the spill. The company's credit default swaps, protecting its debt, rose 35 basis points to 157 basis points on Wednesday, more than double their level a few days before, according to Markit Intraday data.

Sirius XM Radio (Nasdaq: SIRI) CEO Mel Karmazin has said that he is not interested in executing a reverse split, now that his company is back in compliance with Nasdaq OMX Group's minimum listing requirements.

Investors may have a different idea.

Last week's shareholder meeting delivered overwhelming approval of an extension for the authorization for a reverse split. Sirius XM now has 13 months to execute the move. It would have expired at the end of this month if stockholders had voted the proxy initiative down.
